The law provides grants to two types of organizations: federal transfer funds account for about one-third of state funding and more than half of state funds for health care and public assistance. States administer these federal funds based on local priorities. Many ways of financially supporting civil legal aid flow from the powers of states to manage these sources of funding. The Legal Aid Grant Program was established in 1984 to distribute IOLTA revenues to nonprofit legal aid organizations under California Business and Professions Code Section 6210 et seq. (the Statute). Each year, the California State Bar Association awards approximately $30 million in IOLTA and EAF grants to approximately 100 nonprofits. In 2015 and 2016, the state bar received about $51 million in grants resulting from settlements between the U.S. Department of Justice and Bank of America and Citi. The State Bar administers these grants to legal aid organizations to provide legal aid to prevent seizures and legal assistance for community rehabilitation. The grants began in 2016 and will continue until at least 2022.
