Legally Enforceable Stop Sign

Cavalier Steve admits that law enforcement is unlikely to proactively monitor stops in a parking lot. This was recently raised in a local association of PA homeowners. Legally, they own the roads in their development, but they have put up stop signs to clearly indicate who has the right of way and have asked the municipal police to enforce them. A resident challenged the police`s right to enforce traffic laws on private property, but lost his appeal (albeit at the municipal level). The judge stated that residents and all visitors had a reasonable expectation that the road signs would be respected and that, therefore, the violation of the signs was just as dangerous as the offence on the public highway, and that, therefore, the same law and the same penalties would be applied. Note that if you end up in a parking accident, the police will notice traffic control signs and equipment. in which your insurance company may be interested in ignoring published devices that caused an accident. Q: I am curious to know if stop signs located in the parking lots of shopping malls and other private properties have the same weight as a sign located at a public intersection. If someone crossed a stop sign in a parking lot, would they be fined the same as refusing to stop on a street corner? Fire lanes and disabled parking spaces are different because they are imposed by national and sometimes local laws.

The owner must comply with certain rules concerning the number of spaces for disabled persons and the location and signage of fire lanes and parking spaces for persons with disabilities. All of this means that the police can enforce these laws on private property. Steven Montiero, better known as „Trooper Steve,“ joined News 6`s morning team in October 2017 as a road safety expert. Montiero, a decorated combat veteran from Central Florida, arrives at the station after an eight-year stint with the Florida Highway Patrol. Captain Curtis Cox of Guilderland Police added that some streets in shopping malls and other private property are actually city streets. The street around Western Avenue around Crossgates Mall is a city street, he said, and the signs are fully enforceable. Most parking lots have speed limit signs on their walls. However, if there are no signs, you should limit the speed to a maximum of 15 miles per hour. There is no reason for you to exceed the limit. Parking lots are usually filled with pedestrians, especially children. You need to be on high alert and therefore drive slowly. Frequent accidents in parking lots occur between vehicles removing from spaces and vehicles moving down the driveway.

Disabled parking spaces and firewalls are different because they are imposed by the state and sometimes by local laws. Owners must comply with specific rules regarding the number of spaces for disabled people as well as the signage and location of parking spaces for disabled people and fire lanes. And if they are not enforceable, what is the point of them?!? Using turn signals in a parking lot can save your parking space. Turn signals are used to show others the intended direction of your car. Do you want to drive into an empty parking space and there are vehicles behind you? All you have to do is simply turn on your blinders. When you turn on your turn signals, you not only protect other vehicles, but you also signal to pedestrians that they can walk safely through the metal and concrete jungle. Upstate NY here. You`ll see them everywhere: private parking (mall parking, Lowes/Target/Walmart parking, etc.) with stop signs, disabled parking, double yellow lines.

The same signs/markings you see on the open/public road. I realize that they are there to control traffic and serve for our own safety, and I certainly stop when I see one, I just wonder if it is the same as they are not on a public road. Police officers cannot enforce road signs placed on private property. If there is an accident or accident, the police officer will indicate in the report that traffic control signs were present, and the insurance company responsible for the compensation will take this into account. However, there are a few exceptions: if you park your vehicle in a disabled parking space or in a fire department`s driveway, the police officer will issue you a ticket. These signs are generally enforceable, and tickets can be issued for violating these signs as long as they are properly affixed. Some of the streets in shopping malls and other private properties are public roads and, therefore, signs on these roads are fully enforceable. Stop signs should give way. If the rules of the road are not enforced in the parking lots, chaos will ensue.

A: Lt. Ken Pero of the Colony Police said officers generally can`t get tickets for disobeying signs in parking lots, but that doesn`t mean it`s a good idea to ignore them. Get into an accident, and the insurance company will surely make sure that the cause is a driver who has decided, „What the hell, I don`t have to legally stop at that red octagonal sign with white writing.“ With regard to the exits and entrances of car parks, the signage installed in these places is intended to regulate the way in which traffic enters or leaves the installation and interacts with the public road. These signs and signs are legally binding. So if you turn left against a „turn right only“ sign, you`ll get a ticket. For example, if you cause an accident by knocking over a stop sign, you are civilly liable, and if the accident results in injury, you are criminally liable. In addition, several regulations prohibit „reckless driving“ in off-street parking garages, whether private or public, and all impaired driving laws remain in effect. „By eliminating the signaled exit and moving all traffic to a signalled exit a little further east of the roundabout, we would probably compound the problem, as all traffic in the complex, both eastbound and westbound (right and left), would trigger the signal and stop traffic,“ he added. In parking lots where there are no arrows to determine the direction, you should look at how the parking lots were built. If the aisles are vertical, it is probably a two-way car park, vehicles can travel in both directions. If the parking spaces are placed diagonally, you should take a second and look again to determine the flow of traffic in the driveway. The direction of the diagonal spaces indicates the flow of traffic.

If the stalls on both sides of the aisle all point inward, then it`s a one-way street. Remember that you should only drive in the direction in which you can easily enter a parking lot. „Otherwise, it stays green on Sand Creek Road,“ he said. „The signposted intersection is primarily used by drivers turning left and heading west on Sand Creek. Those leaving the complex heading east and turning right use the lower exit without a signal. Lawrence, a News 6 viewer, asked Jumper Steve: „Are stop signs painted on the ground in a parking lot like Publix a legal stop? I watch people go through them all the time. „The stop signs should give way,“ he said. „Traffic rules apply to parking spaces. Otherwise, there would be chaos. Local governments can also enact local laws that require road signs, which would also make them enforceable. So my question is: Are these signs legally enforceable because they are on private property? For example, if I don`t stop at a stop sign in a Walmart parking lot, can I get a ticket? If so, how?? I couldn`t put up a stop sign in the middle of my backyard and ask the police to hand out tickets if someone crossed my lawn and disobeyed them.

The answer to the above question depends on whether the parking is private or public. Public car parks (local or state) (garages or land) are subject to the „rules of the street“. However, private land (a large part of shopping malls) is not subject to traffic laws. If you use a stop sign in a private car park, you will not receive a ticket. However, this does not mean that the driver can drive the vehicle without safety precautions. „These signs are enforceable and tickets can be issued for these violations as long as they are properly posted,“ he said. „Any traffic control sign on private property cannot be enforced by police,“ Pero said. „If an accident were to occur, the officer would note in the report that traffic control signs were in place and insurance companies would take that into account.“ Thomas Mates is a digital storyteller for News 6 and ClickOrlando.com. By separating eastbound traffic leaving the complex from westbound traffic leaving the complex, we improve traffic flow on Sand Creek. The combination of east and west traffic leaving the complex would interfere with traffic on Sand Creek in a manner opposite to that desired. They serve as indications from the owner to the visitor.
