Army Law Tribunal

In 1999, the 169th Report of the Law Commission concluded that disciplinary and service issues required early resolution and proposed the establishment of a special tribunal for the armed forces (i.e., Indian Army, Indian Navy and Indian Air Force) The Armed Forces Court is a military court in India. It was established under the Armed Forces Tribunal Act 2007. [1] [2] The main bench is located in Delhi. There are ten[3] other benches throughout the country. [4] The Court conducts its proceedings in accordance with the rules of the 2008 Armed Forces Tribunal (Procedure). All proceedings before the Court of Justice shall be drawn up in English. The Tribunal will normally follow the procedure as practised in the High Courts of India. The dress prescribed for court officials, including the bar, will be a white shirt, collar band and black coat/jacket. The Armed Forces Tribunal Act 2007 was passed by Parliament and led to the formation of the AFT with the power to decide or prosecute by the Armed Forces Tribunal disputes and complaints relating to enlistment, appointments, enlistments and conditions of service concerning persons subject to the Army Act 1950, to the Navy Act, is envisaged. 1957 and Air Force Act, 1950. It may also provide for appeals arising from orders, findings or judgments of courts martial imposed under those Acts, as well as matters relating to or relating to them. In addition to the main bench in New Delhi, AFT has regional benches in Chandigarh, Lucknow, Kolkata, Guwahati, Chennai, Kochi, Mumbai, Jabalpur, Srinagar and Jaipur. With the exception of the Chandigarh and Lucknow regional benches, which each have three benches, all other sites have a single bank.

Each panel is composed of one judicial member and one administrative member. Judicial members are retired judges of the Supreme Court, and administrative members are retired members of the armed forces who have held the rank of Major General/equivalent or higher for a period of three years or more, the Advocate General of Judges (JAG), who has held the position for at least one year, also have the right to be appointed as administrative members. The Armed Forces Tribunal was inaugurated on 8 August 2009 by His Excellency the President of India.
